Kiefer Sutherland faces jail if he is convicted of DUI, under California's two strikes system. Kiefer was on his way home from a Fox network party when he was pulled over by police on the junction of La Cienega and Beverly at 1.35am after making an illegal U-turn. A breath test found him to have twice the legal limit of alcohol in his system. Sutherland was arrested for misdemeanor DUI, booked and released on $25,000 bail. It's the second time Sutherland has been arrested for DUI - he was caught committing the same offense in California in 2004. He will appear before a California court on 16 October to answer charges and, if convicted, faces a mandatory five-day jail sentence. Sutherland is also currently serving a five-year probation term for the prior DUI. If a judge deems Kiefer violated those terms, "Sutherland could get up to 60 days in jail or worse, depending on varying circumstances,".
